2 common questions about commercial insurance:
What is employers (stop gap) liability? The state of Wyoming is one of only 7 states that have monopolistic workers compensation laws. That means that the state manages the workers compensation insurance program. Employers liability added to your General liability policy fills the coverage gap from Wyoming’s workers compensation insurance including the following:
Third party action over claim—liability to a third party as a result of an injury to your employee that was claimed against the other party. Example—a machine manufacturer is sued by one of your employees due to an injury sustained from one of its machines while the employee is working for you. The machine manufacturer proves that the accident occurred due to improper maintenance. This claim would not be covered by workers comp, but would be covered by your employers liability coverage.
Loss of companionship claim—a spouse sues for payments due to loss of companionship as a result of an employee’s death while on the job. This claim would not be covered by workers comp, but would be covered by your employers liability coverage.
Dual capacity claim—bodily injury to your employee that arises out of and in the course of employment, but claimed against you not in your capacity as an employer. Example—a company manufactures power tools and uses some of its manufactured tools in the manufacturing process. A worker is injured when a power tool he is using breaks. The person sues the employer for manufacturing a faulty product. This claim may be covered under workers compensation but would be covered under employers liability coverage.
What is the difference between Additional Named Insured and Additional Insured? A named insured is a true owner of the policy. So, being an additional named insured essentially means two things. First, the administrative headaches that go along with owning an insurance policy will be a responsibility of the additional named insured in the event that the first named insured fails to live up to those responsibilities under the policy. For example, if the first named insured doesn’t pay the premiums, then an additional named insured could be left footing the bill.
What are additional insureds? Instead of being “owners” of the policy, are parties to whom the policy holder has chosen to extend coverage. As an additional insured, a party should attempt to maximize coverage by trying to mirror the terms granted to the named insured as closely as possible. While negotiating for as much coverage as possible would be a primary goal, becoming an additional insured also avoids the costs and responsibilities that accompany “owning” an insurance policy.
Three most common riders on commercial policies:
Employers Liability (Stop Gap)—See explanation above.
Hired/Non owned auto coverage—Provides liability coverage for your business if employees are involved in an at-fault accident while on the job. Also provides liability coverage for vehicles you may be renting on behalf of your business.
Business Income—Provides coverage for loss of income as a result of a covered loss to a building used in your business. Coverage is also available to continue to pay employees in order to retain them during the rebuilding process an for advertising costs to retain current customers.
